時論者多欲復肉刑。融乃建議曰:「古者敦庬,善否不別,吏端刑清,政無過失。百姓有罪,皆自取之。末世陵遲,風化壞亂,政撓其俗,法害其人。故曰上失其道,民散久矣。而欲繩之以古刑,投之以殘棄,非所謂與時消息者也。紂斮朝涉之脛,天下謂為無道。夫九牧之地,千八百君,若各刖一人,是下常有千八百紂也。求俗休和,弗可得已。且被刑之人,慮不念生,志在思死,類多趨惡,莫復歸正。夙沙亂齊,伊戾禍宋,趙高、英布,為世大患。不能止人遂為非也,適足絕人還為善耳。雖忠如鬻拳,信如卞和,智如孫臏,冤如巷伯,才如史遷,達如子政,一離刀鋸,沒世不齒。是太甲之思庸,穆公之霸秦,南睢之骨立,衛武之初筵,陳湯之都賴,魏尚之守邊,無所復施也。漢開改惡之路,凡為此也。故明德之君,遠度深惟,棄短就長,不苟革其政者也。」朝廷善之,卒不改焉。
