21  | 孝文時，賈誼上疏曰，古者廉恥節禮，以治君子，故有賜死而無戮辱，是以黥劓之罪不及大夫，今自王侯三公之貴，皆天子所改容而禮之也，而今與眾庶同黥劓髡刖笞傌棄市之法，被戮辱者不泰迫乎，夫嘗已在貴寵之位，今而有過，廢之，可也，退之，可也，賜之死，可也，滅之，可也，若夫束縛之，係緤之，輸之司寇，編之徒官，司寇小吏，詈罵而榜笞之，殆非所以令眾庶見也，是時丞相周勃免就國，人有告勃謀反，逮繫長安獄治，卒亡事，故誼以此譏上，上深納其言，養臣下有節，是後大臣有罪，皆自殺不受刑，至武帝時稍復入獄，自寧成始。賈誼傳。 |
